CALDWELL- Months before a 15 year old girl was sexually assaulted in Caldwell, a petition was filed to get her out of the house.
On June 29, police arrested Edward Clinton Lee for allegedly sexually assaulting a 15 year old girl and killing her grandmother.
In February the Texas Center for Defense of Life filed a petition to get that girl away from Lee. Lee, the girl, and the girl's step grandmother were living under the same roof.
"There was absolutely no legal reason, custody or otherwise, for him and her to be in the same house," Stephen Casey with the Texas Center for Defense of Life said.
In 1993 Lee was convicted of exposing himself to a 13 year old girl making him a registered sex offender. The petition argued that being around him was not right for the teenager. The girl was also pregnant, and the petition says she was being talked into an abortion.
"There are text messages from her to her biological mother who lives out of state," Casey said. "Saying, 'Who's pressuring you to do this?' and one of those people was the now deceased grandmother and Mr. Lee."
"She's 15 years old and she's admitted to smoking and drinking and she's pregnant. That to me suggests, well this parental situation has failed."
The case went to court, but those documents are sealed under a court order. However, the Texas Center for Defense of Life says the judge did not take her from the home.
"What we were presenting," Casey said. "Wasn't enough reason to remove her from that situation, and as hindsight is 20/20, now we can see there was cause for concern."
Lee is still in Burleson County jail on a $2.5 million bond.
